By accessing or using the Site, including Browse products or placing an order, you agree to be bound by these Terms and Conditions ("Terms"). Governing Terms: Your use of the Booking Service is governed by these Giraux Fine Jewelry Terms and Conditions and our Privacy Policy. We have integrated SimplyBook.me as a service supplier, and these Terms outline your agreement with Giraux Fine Jewelry for the use of this booking functionality.
Service Facilitation: SimplyBook.me Ltd. operates the underlying technology for the Booking Service and processes your personal information on our behalf and as our supplier, strictly for the purpose of managing your bookings and related communications as instructed by Giraux Fine Jewelry. Accuracy of Information: You agree to provide accurate, current, and complete information as prompted by the Booking Service forms.
Confirmation and Communication: The Booking Service will be used to send you confirmations and reminders regarding your appointments.

By using the Booking Service, you confirm that you understand and agree to these conditions regarding its provision through SimplyBook.me Ltd. as managed by Giraux Fine Jewelry.

Product Information and Pricing We make every effort to ensure that product information, including descriptions, pricing, and availability, is accurate and up-to-date. However, errors may occasionally occur. Giraux Fine Jewelry reserves the right to correct any errors and to cancel or refuse any order placed with incorrect information. Prices and availability are subject to change without notice. Due to fluctuations in precious metal markets and the dynamic nature of tariffs and duties, all price quotes provided by Giraux Fine Jewelry are valid for twenty-four (24) hours from the time they are issued, unless otherwise stated in writing. After this period, quotes are subject to revision based on current market conditions. As company policy, Giraux Fine Jewelry does not honor erroneous pricing. In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error, system error, or error in pricing information received from our suppliers, Giraux Fine Jewelry shall have the right to refuse or cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged for the purchase and your order is cancelled, Giraux Fine Jewelry will issue a credit to your payment method in the amount of the charge.

Custom and One-of-a-Kind Pieces Many of our pieces are custom-made or one-of-a-kind. These items are final sale and not eligible for return. If you have any questions before making a purchase, please contact our customer service team.

Diamond Upgrade Policy Giraux Fine Jewelry offers a diamond upgrade program for eligible diamond purchases. To qualify for an upgrade, your original diamond must have been purchased directly from Giraux Fine Jewelry and be accompanied by its original documentation, including the certificate of authenticity and receipt of purchase. The original diamond must be returned in its original condition, free from damage, chips, or alterations. Upgrade purchases must be for a diamond of greater value than the original purchase price. A credit equal to the original purchase price (excluding taxes, shipping, and any promotional discounts applied) will be applied toward the new diamond purchase. The upgrade credit is non-transferable and has no cash value. Custom settings, mounted diamonds that have been altered, and diamonds purchased as part of promotional packages may have different upgrade terms or may not be eligible. Giraux Fine Jewelry reserves the right to modify or discontinue this Diamond Upgrade Policy at any time. Order Acceptance and Cancellation Receipt of your order does not signify our acceptance. We reserve the right to accept or decline your order for any reason. If we cancel an order after you have been charged, we will issue a full refund.

Returns and Refunds Returns are subject to our Return Policy, available on the Site. Items must be returned in their original condition, with tags and packaging, and accompanied by proof of purchase.

Indemnification You agree to defend, indemnify, and hold harmless Giraux Fine Jewelry, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms, your use of the Site, or your infringement of any third-party rights.

Limitation of Liability Giraux Fine Jewelry shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use or inability to use the Site or products. In no event shall our liability exceed the amount paid for the product in question. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation or exclusion may not apply to you.

Both parties waive the right to a trial by jury.

Mandatory Binding Arbitration: You and Giraux Fine Jewelry agree that any Dispute shall be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), both of which are available at the AAA website www.adr.org. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Rules and, where appropriate, limited by the AAA Consumer Rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so.

Exceptions to Arbitration: Notwithstanding the foregoing, either party may bring an individual action in small claims court or seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.

Governing Law and Venue: These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. For any actions not subject to arbitration as outlined above, or if arbitration is found not to apply, any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of California in each case located in the City and County of San Francisco. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Any relief awarded in any arbitration or court proceeding will be on an individual basis and limited to what is necessary to resolve the specific dispute. If any part of this Dispute Resolution section is found to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Force Majeure Giraux Fine Jewelry shall not be liable for any failure or delay in performance under these Terms due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

International Orders Orders placed outside of the United States and Canada are managed by our international fulfillment partners and may be subject to separate terms and conditions as outlined by those providers.

Links to Third-Party Sites The Site may contain links to third-party websites or services that are not owned or controlled by Giraux Fine Jewelry. Giraux Fine Jewelry has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Giraux Fine Jewelry shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
